POLICY LIMITS RECOVERY FOR FRACTURED VERTEBRAE
Zayed Law Offices represented a woman who suffered a fractured vertebra in an accident caused by octogenarian. Our client was driving in the far right lane of a 4 lane road when the defendant t-boned our client while exiting a private driveway behind a Wal-Mart. Our client, fortunately, did not require surgery, but MRIs showed she had a fractured vertebrae that was attributed to the collision by our client’s orthopedist. Our client was also diagnosed with aggravation to a pre-existing back condition.
Unfortunately, the investigating police officer was unable to determine fault at the scene of the occurrence, and witnesses who arrived at the scene of the accident after the fact also supported the defendant. However the defendant’s version of the story did not withstand the scrutiny of a deposition. And after the deposition of our client’s treating orthopedic doctor, and after significant litigation, this case settled for the insurance policy limits of $100,000.
