How Common Are These Situations? 

Sadly, nursing home abuse and neglect is incredibly common. You have a combination of residents who may have a lot of medical, physical, and psychological needs that need to be fulfilled with many staff that may be underpaid and undertrained for the job. This can lead to staff not knowing what to do in certain situations and just becoming frustrated. Even someone who would normally never do something abusive may have a different tact about things if they are in a stressful enough environment. It is truly terrible that this is a possibility, but we have to be honest with ourselves and understand that it is. 

What To Do At The First Sign Of Abuse 

The moment you notice abuse in a nursing home you should report it to the proper authorities. In the vast number of cases this means reporting it to the local police department. You should allow them to collect evidence and statements from the residents. 

The police will file an official report that details all that they have found. That could prove to be incredibly important in the event that litigation against the nursing home and/or its employees is necessary. Do not try to directly intervene in a situation unless you are seeing abuse actively happening before your eyes and your intervention is the only thing that could prevent someone from further harm or injury. 

Types Of Abuse 

There are different types of abuse that one may experience in a nursing home. Most of us think of the physical forms of abuse when this subject comes up, but there are other ways in which a person may be harmed as well. Psychological abuse is quite common for example as is sexual abuse. The main issue here is a power imbalance. Staff have a great deal of power over residents who may not be able to defend themselves in any significant way. 

Another area of abuse of the elderly is financial exploitation. Sometimes staff see an opportunity to take advantage of the fact that someone is in a nursing home by extorting them for money. This is illegal and immoral, but that is not going to stop certain types of people from pulling this trick anyway. That is when you know there is a serious problem. 

Anything that is being done that does not seem like it should be done and appears to be potentially abusive may well fit into the criteria for honestly being rather abusive. It is okay to question these things and try to figure out if you are correct in your assumptions. You may well be on to something. 

Hire An Attorney 

You do not have the luxury of waiting around a while before hiring an attorney. The longer that you wait, the more abuse may occur. In addition to that, there is a statue of limitations that is applied to these types of cases. If you do not file a lawsuit within the parameters of the statue of limitations, then you are not going to be able to file one at all. Given this, it is critical to make sure you get to an attorney as soon as possible. 

The attorney will be the best advocate that you can get for yourself and your loved one. They will dig up whatever they need to in order to find evidence of the abuse that is being alleged. It is their job to make sure you are served as best as possible in the courts. They always want to make sure that you know that they are working on the case and seek to find as desirable of a result as possible for your case. 

Nothing can take back the abuse that your loved one has had to suffer in this situation, but at least there are things that can be done to seek justice after the fact. That may be the only saving grace out of all of this.
